EPCRA TIER II REPORTING CHANGES

In accordance with 40 CFR 370, facilities that store greater than 10,000 pounds of any hazardous chemical on site, or greater than 500 pounds or the specific threshold planning quantity for extremely hazardous substances (EHSs), must submit Tier II reports to the state emergency response commission (SERC), local emergency planning committee (LEPC), and local fire department by March 1, 2014. The EPA has made significant changes to the Reporting Year 2013 Tier 2 report, including requirements for additional detailed information about facilities and chemicals.

FINAL RULE ON CLEAN WATER ACT SECTION 316(b) SET FOR APRIL 17, 2014

The EPA will issue a final rule on Section 316(b) of the Clean Water Act for existing facilities by April 17, 2014. Previously delayed, the ruling will require cooling water intake structures to reflect the best technology available in minimizing adverse environmental impact.

ustMASSDEP RELEASES STAGE I & II AMENDMENTS & UNDERGROUND STORAGE TANK REGULATIONS

The Massachusetts Department of Environmental Protection has released proposed regulations that would require some gasoline dispensing facilities to decommission their Stage II vapor recovery systems and implement enhanced Stage I vapor controls. The new rule would also change existing regulations for Underground Storage Tank (UST) program implementation. Public comment on the matter is open until March 31, 2014.
